Copyright Infringement Stirkes Again!!

I got my first strike for a Sinbad fandub.

The video I posted did not receive a strike until about 4 months after I had posted it.
The copyright claim was made by a "third party". Which means it was disabled because someone from Paramount Pictures filed a complaint about my video.
I also got an email alerting me of the strike.

I filled out a dispute form claiming "fair use"
About a week later I received an email from alfred_perry@paramount.com
The email said only this:

"Jessica, what number may I try to reach you? "

So I googled it, and he is the Vice President of business and legal affairs at Paramount.
Little scary.
I emailed him back and gave him my number.
I am going to talk to whatever representative calls me and plead to have the strike removed from my account.

I had three strikes total on my old account. One I did dispute and win, and the other two I lost. The strike I disputed was for a cover of 'Green Finch and Linnet Bird' from Sweeney Todd. It was from whatever company produced the film. I really can't remember who it was. I e-mailed them through YT and it got sorted out in a matter of weeks. That was that.

The secon strike I received was for a song from 'The Rocky Horror Picture Show.' It was FOX, which you never win against.

The third, well second that they counted, was for my cover of 'Journey to the Past' from Anastasia. I lost.

None of these strikes happened until my videos got loads of views, I had nearly a million on the Rocky Horror one (crazy I know!!!) and then they flagged it. The Anastasia song had around 10,000 views before it was flagged, and the Sweeney Todd song had well over 1,000. I used to get a lot more views. I have no idea how.

At this point, I am pretty much going to refrain from using video in most cases, except for some choice Disney stuff. I know you video edit, but I don't want to risk it again.

I would stay away from FOX and warner, I've heard the worst about them. Good luck.

Sooo... I got my phone call today.
Al is nice.
He says that while they don't want their materials being used, he can understand how it is confusing to youtubers that some film makers actually encourage the fan-creations.
He said as long as I have agreed to delete the material, that he will contact youtube and inform them that they are satisfied in this instance and see if the strike can be removed.


Don't use anything made by Paramount (Dreamworks) - they dont like it

I got a strike for my '16 going on 17' video. It wasn't actually a video. Just a photograph and instrumental, with ms100what ever is name is, singing as Rolf, and me as Liesl. I might dispute it but I was scared to draw more attention to my account in case I get more strikes lol! That's lame, Jess, I hope you get it sorted... I'm actually thinking I might dispute mine now because I don't think it was actually infringing copyright...

I've been curious about something with copyrights and such with youtube videos. I know I have a warning (not a strike) about my "At the Beginning" video that features a music video of Anastacia clips. Would it be best to remove it now so I don't get a strike for it?

But yeah, don't use anything from Fox. The party poopers...

If I were you I would remove it. FOX has a tendency to find things when you least expect it.

The strike is gone!!


Basically what I learned is that you have to find a way to contact the person/company that put the strike against you in the first place.
A lot of them just think they are removing the material, and they don't realize you even getting a strike for it.

I found another person who got a strike removed because the contacted he company directly, before he even filed the official dispute form.
They didn't give him permission to use the material, but they helped him remove his strike as well.
Contacting people isn't as hard as you might think.
Just use your google-foo.
It can't hurt to try.

If you want to contact the copyright holders directly this might help:

You'd actually have to mail them a letter, but you still wouldn't have to go through youtube.
I wouldn't ask that they necessarily restore your material.. just say something along the lines of how you now understand they don't allow their materials to be used on youtube, even in small amounts, or for fan creations... and while you respect that and are more than willing to remove their stuff from your channel, you want to know if their is anything you can do to have the permanent strike removed from your youtube account, that resulted from their copyright claim because it could result in termination of your youtube channel.

Or you could try to track down email addresses for their legal departments.

Or you could just go through youtube and fill out the dispute forms. Although some people say they think you can get in more trouble by doing this... I dont know why though...I've never heard of anyone who actually has had that happen.

I went through youtube.
I filled out the dispute form, and youtube said that if the person who filed the copyright claim orginally didnt respond within 14 days, the strike would be removed.
I figured they probably would be to busy to respond... But he wound up emailing me asking for my contact info.


The other guy I ran into on youtube who got a strike removed, just contacted the studio directly and had them contact youtube on his behalf to remove the strike.

If you DO have more stuff on your channel which is copyrighted by the same people, it would probably be best to take it down or set it to private if you can't bare to delete it.
Because they'll find it eventually... whether or not you draw their attention to it now.

And the way I see it removing a few songs, is better than having to start over at a new channel. =)

And I am putting my copyright infringing stuff on there.
Because I started working on a crossover series, and one of my main characters was dreamworks... and I couldn't bare to just throw the whole thing out before anyone even saw it.

And I am just going to try to be as careful as possible on my main channel... as far as what I sing.. pitch changing songs slightly...and I won't use ANY video footage that isn't disney.
